Marriage Registration Guide

Marriage registration is a fundamental legal procedure that ensures the rights of both spouses and their future children under Afghan Law. The Embassy provides services to register marriages and issue the official Marriage Certificate (Nikah Khat), which is recognized by government institutions in Afghanistan.

This guide outlines the legal requirements and administrative steps necessary to register a marriage in accordance with the Civil Law of the Islamic Republic of Afghanistan and the principles of Islamic Sharia.

Eligibility and Jurisdiction

The Consular Section accepts applications for marriage registration primarily when both applicants are Afghan citizens. In cases where one party is a foreign national, specific additional legal requirements and NOCs (No Objection Certificates) may apply to ensure the marriage is valid under Afghan jurisdiction.

Applicants must be residents of the country where the Embassy is located. Proof of residence is required to initiate the file.

Required Documentation

To prevent delays, applicants should ensure a complete file is prepared prior to their appointment. The standard documents required include:

  • Proof of Identity: Original Tazkira (National ID) or valid Afghan Passports for both the bride and the groom.
  • Proof of Residence: Valid residence permits or visas for the host country.
  • Health Certificate: A recent medical report confirming that both parties are free from hereditary blood diseases (such as Thalassemia) and other communicable diseases.
  • Photographs: Recent standard passport-sized photos of both spouses.
  • Evidence of Unmarried Status: If not previously married, an affidavit or status certificate may be required. If previously married, a divorce decree or death certificate of the former spouse is mandatory.

The Role of Witnesses

In accordance with Islamic jurisprudence, the presence of witnesses is mandatory for the validity of the marriage contract. The registration process requires the physical presence of:

  • Two Male Witnesses: They must be adult Afghan citizens holding valid identification (Passport or Tazkira).
  • Verification: The witnesses will be required to sign the Marriage Certificate in the presence of the Consular Officer to attest that the marriage is taking place with the free will and consent of both parties.

Registration of Foreign Marriages

Afghan citizens who have already concluded a civil marriage in a foreign court or local municipality may wish to register this union with the Afghan authorities to obtain a Nikah Khat. In this scenario, the process is streamlined to recognize the existing union.

Applicants must present the original local marriage certificate. This document usually requires authentication or an apostille from the local Ministry of Foreign Affairs before it can be processed by the Afghan Embassy.

Issuance of the Nikah Khat

Once all documents are verified, the application fee is paid, and the statement of mutual consent is recorded, the Consular Section will issue the official Marriage Certificate. This document is written in Dari/Pashto and English. It serves as the vital legal record for family registration, future passport applications for children, and property matters in Afghanistan.
